By accessing or using Ad Caddy, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Ad Caddy is a desktop application that enables users to:

• Create and publish content to multiple social media platforms (Facebook, Instagram, Threads, LinkedIn, TikTok, YouTube, X/Twitter).
• Schedule posts for future publication.
• View analytics and engagement metrics from connected social media accounts.
• Generate content ideas using AI-powered tools.
• Manage contacts and leads through CRM integration.
• Conduct A/B testing of social media content.

3. User Accounts

• You must create an account to use Ad Caddy.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and complete information when creating your account.

4. Social Media Account Connections

• Ad Caddy requires you to authorize access to your social media accounts via OAuth or API tokens.
• You are responsible for ensuring you have the right to connect and publish to any social media account you link to Ad Caddy.
• You can disconnect any social media account at any time through Ad Caddy's settings.
• Ad Caddy is not responsible for any actions taken by third-party social media platforms regarding your accounts or content.

5. Content and Conduct

• You are solely responsible for all content you create, publish, or distribute through Ad Caddy.
• You must comply with the terms of service and community guidelines of each social media platform you publish to.
• You must not use Ad Caddy to publish content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
• You must not use Ad Caddy for spam, phishing, or any form of unauthorized automated posting.

6. Intellectual Property

• Ad Caddy and its original content, features, and functionality are owned by Ad Caddy and are protected by copyright, trademark, and other intellectual property laws.
• You retain all rights to the content you create and publish through Ad Caddy.

7. Third-Party Services

Ad Caddy integrates with third-party services including but not limited to Meta, TikTok, LinkedIn, X/Twitter, YouTube, Supabase, Anthropic, HubSpot, and Apollo.io. Your use of these services through Ad Caddy is subject to their respective terms of service and privacy policies. Ad Caddy is not responsible for the availability, accuracy, or reliability of these third-party services.

8. AI-Generated Content

Ad Caddy provides AI-powered content generation features using Anthropic's Claude. Content generated by AI is provided as suggestions only. You are responsible for reviewing, editing, and approving all content before publishing. Ad Caddy is not responsible for any consequences arising from the use of AI-generated content.

9. Limitation of Liability

To the maximum extent permitted by law, Ad Caddy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data, revenue, or profits.
• Unauthorized access to or alteration of your data.
• Any social media account suspension or restriction resulting from content published through Ad Caddy.
• Interruptions or failures of third-party services.

10. Disclaimer of Warranties

Ad Caddy is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

11. Termination

We may terminate or suspend your access to Ad Caddy at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may stop using Ad Caddy at any time.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the updated Terms on this page and updating the "Effective Date" above. Your continued use of Ad Caddy after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
